GIFTbase Terms of Use

1. Introduction

Welcome to GIFTbase (hereinafter the "Application", "we", "us", "Company"). The Application is designed to help you organize wishlists and find personalized gift ideas. By using GIFTbase, you (hereinafter the "User") confirm that you have read, understood, and agree to comply with these Terms of Use (the "Terms"). If you do not agree with the Terms, please do not use the Application.

2. Age Restrictions

You must be at least 13 years old to use GIFTbase. However, if the laws of your country require a higher age for providing independent consent to the processing of personal data (for example, 16 in some EU countries), you must comply with that local requirement. If you are a minor, you confirm that your legal guardian has reviewed and agreed to these Terms.

3. Registration and Account Management

Access to the Application's features may require registration, including through third-party authorization services (such as a Google account). You are fully responsible for the security of your credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content and Conduct Rules (UGC)

The Application and the website allow you to create wishlists, play Secret Santa (wishes, anonymous questions and answers), add descriptions, prices, comments, and share them with other users. You retain rights to your content, but you are fully responsible for it.

It is strictly prohibited to create, upload, or distribute content that:

• Is unlawful, abusive, threatening, defamatory, or promotes hatred.
• Infringes the copyright or intellectual property of third parties.
• Is used for bullying or harassment, discloses other people’s personal data, or contains spam or advertising.
• Contains sexual content, including child sexual abuse material (CSAM). We have a zero-tolerance policy for such material.

Moderation: We reserve the right, without prior notice, to monitor, edit, hide, or remove any user content, and to block the accounts of users who violate these Terms. Users may report inappropriate content using the relevant features in the Application or by contacting support.

Secret Santa chat: links, phone numbers, email addresses, handles and rude words cannot be sent in it. Either participant can close the chat or report a message. Reports are reviewed by the GIFTbase team: if a message breaks these rules, it is removed, and the participant may be removed from the game or blocked.

5. Use of Artificial Intelligence (AI)

Some features of the Application (such as generating gift ideas or scenarios) run on artificial intelligence technologies. You understand and agree that:

• AI-generated content is provided on an "as is" basis. We do not guarantee its absolute accuracy, safety, relevance, or appropriateness.
• You independently decide on the advisability of using the ideas suggested by the AI.
• It is prohibited to use the Application's AI features to attempt to generate illegal, harmful, or prohibited content.

6. Paid Services and Subscriptions

Paid Services may be offered within the Application, including:

• Subscription (GIFTbase "Best Friend"): Unlocks premium features (e.g., access to the "Super-personalization" feature, receiving additional monthly "generations" credited to the in-app balance).
• One-Time Purchases: Purchasing a fixed number of generations or other virtual features.

Subscriptions are paid in advance. Automatic renewal occurs at the beginning of each billing period. You can cancel auto-renewal in the settings of the platform through which the subscription was purchased (before the end of the current period).

7. Payment and Refunds

Payment: Payment processing is carried out through built-in payment systems of the Application distribution platforms or authorized third-party payment providers available in the interface. You agree to the terms of service of the selected payment provider.

Refunds: By purchasing subscriptions or digital generations, you acknowledge and agree that digital content is delivered instantly upon purchase or start of generation. In accordance with applicable law and digital store policies (Apple App Store / Google Play), you explicitly consent to the immediate performance of digital services and acknowledge that you lose the right of cancellation once the digital content or service has been delivered or generation has begun.

8. Limitation of Liability

The Application is provided on an "as is" and "as available" basis. We are not liable for service interruptions, data loss, or inaccuracies in AI recommendations. To the maximum extent permitted by law, our aggregate liability for any claims cannot exceed the amount paid by you for Paid Services in the preceding 12 months.

9. Additional Terms for Apple iOS Users

If you downloaded the Application through the Apple App Store, the following additional terms apply to you:

• These Terms are concluded solely between you and GIFTbase, and not with Apple Inc. ("Apple"). We, not Apple, are responsible for the Application.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
• In the event of claims related to the use of the Application, you must contact us, not Apple.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

10. Governing Law

These Terms and any disputes arising in connection with the use of the Application shall be governed by and construed in accordance with the laws of the Republic of Armenia, without regard to conflict of laws principles.

11. Changes to the Terms

We may update these Terms periodically. Changes take effect from the moment the new version is published in the Application or on the website. By continuing to use the Application, you agree to the updated Terms.

The Application is maintained and operated by a Sole Proprietor (IP) registered under the laws of the Republic of Armenia.
